TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

By accessing or using Foundation Fitness (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. Foundation Fitness is operated by Rachel & Robbie Hall (“we”, “us”, “our”).

2. DESCRIPTION OF SERVICE

Foundation Fitness is a fitness tracking application that allows users to build workout programs, log workouts, track progress photos, record body metrics, earn badges, complete challenges, and optionally connect wearable devices. The core Service (workout tracking, body metrics, progress photos, badges, challenges, VO2 Max field test) is provided free of charge. Optional wearable device integrations require a paid subscription.

3. USER ACCOUNTS

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account. You must notify us immediately of any unauthorized use of your account.

4. USER CONTENT

You retain ownership of all content you upload to the Service, including progress photos, workout data, and body metrics. By uploading content, you grant us a limited license to store and process that content solely for the purpose of providing the Service to you. We will never share, sell, or publicly display your content without your explicit consent.

5. ACCEPTABLE USE

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service or its infrastructure
  • Upload malicious code, viruses, or harmful content
  • Impersonate any person or entity
  • Use the Service to harass, abuse, or harm others

6. SUBSCRIPTIONS & BILLING

Subscription Plans

The Wearable Integrations subscription is offered at $9.99/month or $79.99/year. Pricing is displayed on our pricing page and during checkout. The core Service remains free of charge and does not require a subscription.

Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled. Renewal is at the then-current standard rate.

Cancellation

You may cancel your Wearable Integrations subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. You will retain wearable integration access until your paid period expires. The free portion of the Service is unaffected by cancellation.

Refunds

Subscription fees for Wearable Integrations are generally non-refundable. Upon cancellation, you retain access through the end of your current paid period but are not entitled to a prorated refund for the remaining time. If you are unsatisfied within the first 7 days of your first payment, contact us and we will refund you.

Payment Processing

Web payments are processed by Stripe, Inc. We do not store your credit card number, expiration date, or security code. Your use of Stripe is subject to Stripe's own terms of service and privacy policy. iOS subscriptions are processed by Apple through In-App Purchase and are subject to Apple's terms.

Price Changes

We may change subscription prices with at least 30 days' advance notice. Price changes will take effect at the start of your next billing cycle following the notice period.

6.5 FREE VS PAID FEATURES

The following features are provided free of charge to all account holders:

  • Workout tracking and program building (7-Day Weekly, A/B Split, A/B/C Split)
  • Workout history and editing of past records
  • Body measurements and manual metrics entry
  • Progress photos with side-by-side comparison
  • Badges and monthly challenges
  • VO2 Max field test
  • Reading and listening log

The following requires an active Wearable Integrations subscription:

  • Connecting and syncing data from wearable devices and fitness platforms (Garmin, Oura, WHOOP, Withings, Fitbit, MyFitnessPal, and other supported providers) through our integration partner, Terra API
  • Automatic activity, sleep, recovery, HRV, and body composition sync from connected devices

7. WEARABLE DEVICE INTEGRATIONS

Wearable device integrations are an optional paid feature. To connect a device, you must hold an active Wearable Integrations subscription, comp grant, or lifetime access. The Service allows you to connect third-party wearable devices and fitness platforms (such as Garmin, Oura, WHOOP, Withings, Fitbit, MyFitnessPal, and others) through our integration partner, Terra API. By connecting a device, you authorize Terra API to access and transmit your health and activity data to Foundation Fitness. You may disconnect any device at any time from your account settings. We are not responsible for the accuracy, availability, or completeness of data from third-party devices or platforms.

8. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE MAKE NO GUARANTEES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT OR INFORMATION PROVIDED THROUGH THE SERVICE.

9. FITNESS & HEALTH DATA DISCLAIMER

Foundation Fitness is a workout tracking tool, not a medical or fitness advisory service. The workout programs, health metrics, and biometric data displayed within the Service (including heart rate, heart rate variability, sleep data, recovery scores, and similar measurements) are for informational purposes only and do not constitute medical advice, diagnosis, or treatment. This data is not medical data and should not be used to make medical decisions. Always consult a qualified healthcare provider or certified fitness professional before starting any exercise program. You use the Service and follow any workout programs entirely at your own risk. We are not responsible for any injuries, health issues, or adverse effects that may result from the use of the Service.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FOUNDATION FITNESS, ITS OWNERS, OPERATORS, AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

11. INDEMNIFICATION

You agree to indemnify and hold harmless Foundation Fitness and its owners from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising out of your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. TERMINATION

We reserve the right to suspend or terminate your account at any time, with or without cause, and with or without notice. You may delete your account at any time. Upon termination, your right to use the Service will immediately cease. If you have an active subscription, cancellation and refund terms in Section 6 apply.

13. CHANGES TO TERMS

We reserve the right to modify, amend, or replace these Terms at any time and at our sole discretion. Changes may include, without limitation, modifications to pricing, features, service availability, acceptable use policies, and any other aspect of the Service. We will notify users of material changes through the Service. Your continued use of the Service following notification constitutes binding acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the Service immediately.

14. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
